We provide website accessibility and compliance audits. Each audit produces a PDF report identifying issues and providing recommendations. We do not fix issues – this is an audit-only service.

3. Eligibility

You must be at least 18 years old to use our Service. By using our Service, you represent that you have the authority to bind your organization.

4. Purchases and Payments

• All prices are in USD and are clearly displayed at checkout
• Payment is processed by PayPal – subject to PayPal's terms and conditions
• You must provide accurate website URL at checkout for the audit to be performed
• Prices are subject to change with prior notice on our website
• We do not store any payment information on our servers

5. Refund Policy

We stand behind the quality of our audits. We offer a 14-day money-back guarantee under the following conditions:

6. Report Delivery

Reports are delivered via email within 48 hours (business days). We are not responsible for delivery delays due to:

• Incorrect email addresses provided at checkout
• Email spam filters blocking our messages
• Technical issues beyond our reasonable control

7. Intellectual Property

Our reports, website content, and branding are protected by copyright and other intellectual property laws. By purchasing our service, you receive a limited, non-exclusive, non-transferable license to:

• Use the audit report for your internal business purposes
• Share the report with your employees, contractors, or legal counsel as needed to address compliance issues

You may NOT:

• Redistribute, resell, or publicly share our reports without written permission
• Copy, modify, or create derivative works of our reports or website content
• Use our trademarks without prior written consent

8. Disclaimer of Warranties

OUR SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING:

• That the audit identifies ALL potential issues (no audit can guarantee 100% completeness)
• That following our recommendations guarantees protection from lawsuits
• That our service will be uninterrupted or error-free
• Any implied warranties of merchantability or fitness for a particular purpose

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ADASCANPRO AND ITS OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Legal fees, lawsuit costs, settlement amounts, or regulatory fines
• Loss of profits, revenue, data, or business opportunities
• Any amounts exceeding the fee paid by you for the specific audit that gave rise to the claim

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability. In such jurisdictions, our liability shall be limited to the greatest extent permitted by law.

10. Indemnification

You agree to indemnify, defend, and hold harmless ADASCANPRO, its officers, directors, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:

• Your use of our Service in violation of these Terms
• Your violation of any applicable law or regulation
• Your violation of any third-party rights, including intellectual property rights
• Any content or information you provide to us

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Kenya, without regard to its conflict of law provisions. For customers in the United States, this does not limit your statutory rights under applicable US laws.

Any disputes arising under these Terms shall be resolved through binding arbitration in Nairobi, Kenya, in accordance with the rules of the Nairobi Centre for International Arbitration. Each party shall bear its own costs and attorneys' fees.

12. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to our website. Your continued use of our Service after changes constitutes acceptance of the modified Terms.

13. Severability

If any provision of these Terms is held to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
